Privacy policy
LUXURY BRAND MARKETING, LLC
Effective October 28, 2026 | Website: https://agencyofluxury.com
1. Introduction
Luxury Brand Marketing, LLC (‘LBM,’ ‘we,’ ‘our,’ or ‘us’) values privacy and discretion. This Policy describes how we collect, use, disclose, retain, and protect personal information through agencyofluxury.com (the ‘Website’), our business communications, consultations, marketing, and services.
This Policy covers information LBM handles for its own purposes. When LBM processes personal information on behalf of an agency client, the client may control that information, and applicable contracts and the client’s privacy notice may also govern. This Policy does not replace those agreements.
2. Who We Are and Contact Details
Controller/business contact (where LBM determines purposes and means): Luxury Brand Marketing, LLC, Ocala, Florida, United States. Website: https://agencyofluxury.com. Privacy requests and questions: privacy@agencyofluxury.com.
If a law requires a further contact method or mailing address, we will provide that method as applicable. An individual seeking to exercise rights over information processed for an LBM client may also need to contact the relevant client directly.
3. Information We Collect
Information provided directly
Professional contact information (name, business, title, email, telephone); inquiry and consultation details; messages and correspondence; proposal, contract and billing information; account or project-related information; subscription preferences; and other information voluntarily submitted.
Information collected automatically
Depending on deployed tools, internet protocol address, browser and device information, visit dates, pages viewed, referral sources, interactions with content or forms, cookie identifiers, and online advertising or analytics events.
Other sources
We may receive professional contact and business information from referrals, public business sources, networking channels, clients, advertising platforms, and providers, subject to applicable law. Client datasets may contain contact and campaign information obtained and controlled by the client.
Please avoid submitting sensitive personal information through routine website forms unless specifically requested and authorized.
4. Our Purposes for Processing
We process information to respond to requests; evaluate prospective engagements; provide brand, strategic, creative, advertising, search and digital marketing services; communicate about projects; administer contracts and invoices; operate and secure the Website; analyze performance; conduct permitted marketing; detect misuse; meet legal obligations; and establish or defend legal claims.
Where applicable laws require a lawful basis, we rely on consent, performance of or steps toward a contract, legal obligation, and/or legitimate interests such as business communications, security and improvement, as appropriate to the processing. Consent can be withdrawn where processing depends on it.
5. Cookies, Analytics and Advertising Technologies
Our Website uses strictly necessary cookies and, depending on your location and choices, analytics and advertising technologies. These currently include Google Analytics 4 and Google Tag Manager (website analytics and measurement) and the Meta (Facebook) pixel (advertising measurement and audience matching). We may add, remove, or change these tools over time. Such technologies collect identifiers and browsing or interaction data and may transmit information to the relevant technology providers, who process it under their own terms.
You can block cookies through your browser controls. Where required by law, we obtain consent for non-essential technologies before they load and provide applicable controls, including a consent banner in regions that require one. Sale/sharing and targeted-advertising opt-outs are addressed separately in Sections 6 and 7, because consent tools and opt-out mechanisms serve different legal purposes.
6. Sale, Sharing, and Targeted Advertising
LBM does not sell personal information for money. We share the categories of information described in Section 3 with the service providers and the advertising and analytics platforms described in Sections 5 and 8 - including Google and Meta - to operate and measure the Website and to deliver and measure our own marketing. Under some state privacy laws, using advertising identifiers or pixels for these purposes may be treated as a sale, as sharing, or as targeted advertising even when no money changes hands.
Where an applicable law covers LBM and these activities qualify as a sale or as sharing for targeted advertising, eligible individuals may opt out by emailing privacy@agencyofluxury.com and by using the Website's data-sharing opt-out and Your Privacy Choices control described in Section 7.
7. Universal Opt-Out Signals
Where required for a covered business, we honor recognized, legally valid universal opt-out preference signals, including the Global Privacy Control (GPC), for applicable sale/sharing and targeted-advertising processing. Our Website is hosted on Shopify, which recognizes these signals automatically in the U.S. states that require it. The technical scope of a signal and the ability to associate it with other identifiers are governed by applicable law.
8. Disclosure of Information
We may disclose categories of information described in Section 3 to service providers and contractors for hosting, cloud collaboration, communication, customer relationship management, analytics, advertising delivery, financial administration, security and professional advice; to advertising and social platforms as applicable; to a buyer or successor in a business transaction; and to authorities or others when lawfully necessary.
Some third-party platforms independently determine purposes for their processing and provide their own privacy notices. We do not authorize vendors to use LBM-controlled information for unrelated purposes merely because they provide a service. Vendor contracts and actual practices determine applicable protections.
9. Client Data and Agency Roles
LBM may access client-provided audience lists, lead information, customer and prospect records, conversion events, marketing accounts, and performance data to perform authorized services. The client may be the controller/business while LBM acts as processor/service provider or contractor; roles depend on the particular activity, contracts, and law.
LBM seeks to follow documented client instructions, maintain reasonable confidentiality and access limits, assist with valid rights requests as contractually and legally required, and return or delete client data when required. Client data is not acquired by LBM for unrelated resale or independent marketing solely through an engagement.
10. Artificial Intelligence and Automated Processing
LBM may use AI-assisted tools for content creation, research, search optimization, reporting, and campaign analysis. Before submitting personal information or confidential client information to a third-party AI or automated tool, we consider the applicable client agreement, the authorized purpose, the provider's processing and retention terms, and applicable privacy requirements. We do not represent that AI providers never retain or use information submitted to them for their own purposes, including model training, unless the applicable agreement so provides.
We do not state that automated decision-making with legally or similarly significant effects takes place unless such processing actually occurs. If it does and laws apply, we will provide required notices, assessments, opt-outs, access or other rights.
11. Sensitive Personal Information and Minors
LBM does not request sensitive personal information for ordinary agency inquiries. Sensitive information may include precise geolocation, health information, biometric identifiers, certain financial data, and protected characteristics as defined under applicable law. If processed, it is subject to legal restrictions, consent where necessary, and appropriate security and limits on use.
The Website is directed to business professionals and not children. We do not knowingly collect children's personal information through the Website for independent marketing. If we discover unlawful collection, we will take steps appropriate to the circumstances. Additional protections may apply to minors' data in client campaigns.
12. Data Retention
We retain information only as reasonably necessary based on its category, collection purpose, client instructions, statutory limitations, contractual requirements, legitimate business needs and legal, tax, security or dispute obligations.
Typical categories include: inquiries and prospect correspondence (while evaluating the inquiry and reasonable follow-up); marketing subscriptions (until opt-out, with limited suppression records thereafter); client and project records (through the engagement and necessary post-engagement period); invoices and contractual records (as required for financial and legal obligations); analytics and ad data (under relevant platform settings and campaign arrangements); and client-controlled datasets (subject to contractual retention and deletion instructions). Specific periods and system settings are maintained in applicable internal schedules.
When retention is no longer justified, information is deleted, deidentified or otherwise disposed of appropriately, subject to backup cycles and legal holds.
13. Information Security and Incidents
We use reasonable administrative, technical and organizational safeguards proportionate to the information and activities involved, including appropriate access restrictions, authentication, vendor oversight and incident-response procedures. No internet or electronic storage system is guaranteed secure.
If a security incident affects personal information, we evaluate notification obligations under applicable state laws and our client agreements and provide notifications when required. Where we act for a client, our client agreements may require notification within a specified time - for example, within seventy-two (72) hours of becoming aware of a qualifying incident - and we comply with those commitments.
14. International Transfers
Information may be processed in the United States and other countries through service providers. Where international data protection laws apply, we use applicable safeguards for restricted transfers, which may include approved contractual terms and other required measures.
15. EEA, UK and Other International Rights
Where GDPR, UK GDPR, or other laws apply, individuals may have rights to access, rectification, erasure, restriction, objection, portability, withdrawal of consent and complaints to a supervisory authority, subject to applicable conditions. Contact privacy@agencyofluxury.com to make a request. A separate representative or data protection officer is identified only if legally required and designated.
16. United States State Privacy Notice
Depending on residence, applicability thresholds and exemptions, consumers in California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah and Virginia may have some of the rights below. Florida has a separate narrower comprehensive statute; other federal and state privacy, biometric, health, security and breach-notification laws may apply.
Categories and sources
Our personal information categories and sources are described in Section 3; our processing purposes in Section 4; and categories of recipients in Section 8. Depending on the actual systems used, these may include identifiers, professional and commercial records, internet activity and inferences. Sensitive information is addressed in Section 11.
Consumer rights
Eligible consumers may request access, correction, deletion, portability, and information about categories collected or disclosed; opt out of covered sales, targeted advertising or certain qualifying profiling; limit certain sensitive-information uses; and exercise any additional state-specific rights. Rights, exceptions, response requirements and verification vary by state.
California-specific information
Where LBM is a covered business, California residents may have the rights to know, access, correct, and delete personal information; to opt out of its sale or sharing; to limit the use of sensitive personal information; and not to receive unlawful discriminatory treatment for exercising these rights. For the twelve (12) months preceding the effective date of this Policy, the categories of personal information we collect, the sources, the business and commercial purposes, and the categories of recipients are those described in Sections 3, 4, and 8. California's requirements regarding risk assessments, cybersecurity audits, and automated decision-making technology apply only as their regulatory thresholds and phase-in dates provide.
Requests and appeal
Submit requests to privacy@agencyofluxury.com. Some states require a business to offer at least two methods for submitting requests; California permits a business that operates exclusively online and has a direct relationship with the consumer to offer an email address as the sole method. We may verify identity or authority, seek clarification, and apply exceptions as permitted. We respond within the period required by the applicable state law (generally within 45 days, subject to permitted extensions), and where a law requires it we provide an appeal process and explain how to use it. If we act only on behalf of a client, we may forward or refer the request to the responsible client.
Opt-out choice
If LBM conducts covered sale/sharing or targeted advertising, it provides the consumer opt-out methods and universal-opt-out-signal recognition required by law. Where applicable, a data-sharing opt-out and Your Privacy Choices control is available on the Website in addition to the privacy@agencyofluxury.com contact.
No retaliation
We do not unlawfully discriminate against people for exercising applicable privacy rights.
This notice does not claim that every state law applies to LBM or that every listed right applies to all individuals. Applicability depends on statutory thresholds, exemptions, the relevant processing activities and current law.
17. Marketing Communications
You may unsubscribe from marketing emails using the link provided in the message or by contacting privacy@agencyofluxury.com. We may retain minimal suppression information to respect your choice. Operational, contractual and legally required communications may continue when permitted.
18. Third-Party Websites and Social Platforms
Links to third-party sites, scheduling platforms or social profiles may be provided for convenience. Their handling of personal information is subject to their own notices and terms rather than this Policy.
19. Changes to This Policy
We may update this Policy as our operations, technologies or legal obligations evolve. We will post an updated effective date and give additional notice when required by law.
